يعتبر التحريض صورة من صور الإسهام في الجريمة، لا بل من أخطرها، لأن المحرض يخلق الفكرة الإجرامية لدى الفاعل، فيقوم هذا على تنفيذها.
وفي لبنان، تناول قانون العقوبات اللبناني المحرض بالتعريف، غير أن قوانين وتشريعات أخرى لم تضع تعريفا له، فقد جاء في المادة 217/فقرة 1 من قانون العقوبات اللبناني بأن المحرض هو " كل من حمّل الغير أو حاول حمله على ارتكاب الجريمة".
وبما أن معاقبة كل من له علاقة بالجريمة - أية جريمة - ولو لم يكن تنفيذها قد تم على يديه أمر يحتمه الشرع الإسلامي، والقانون اللبناني، والقوانين الوضعية الأخرى. جاء هذا الكتاب لمعالجة العديد من الإشكاليات في موضوع التحريض. في قانون العقوبات، إضافة إلى اعتماد المؤلف على منهجية إستنباطية ترتكز على النصوص القانونية من جهة، وعلى النظريات الفقهية، والأحكام القضائية التي تناولت هذا الموضوع في لبنان وفرنسا ومصر من جهة أخرى.
وعليه تم تقسيم العمل إلى فصل تمهيدي يتضمن تعريف المحرض وتمييزه وتاريخه وقسمان: القسم الأول يدرس أركان التحريض على الجريمة وهما: الركن المادي والركن المعنوي للتحريض. أما القسم الثاني فتم البحث فيه عن المسؤولية الجزائية للمحرّض وجزاؤه إضافة إلى ما يثيره التحريض من مشاكل قانونية: المحرّض الصوري، وفكرة الفاعل المعنوي ... الخ.
