قيل قديماً "خير أن يكون المجرم طليقاً من أن يكون البريء محكوماً" وهذا يعني أن الأصول الجزائية هي التي تستطيع أن توقف تماماً بين متطلبات المجتمع والحريات الفردية. هذه الفكرة تنعكس جلياً على الوضع العام لأي بلد إذ من الملاحظ أن النظام السياسي والدستوري في بلد ما له تأثير بالغ وعميق على الأصول الجزائية إذ هي تظهر بوضوح مدى الحريات المعطاة أو المرفوضة من الدولة لرعاياها، ذلك أن الأصول الجزائية تتناول الجانب الشكلي للقانون أي "تنظيم الإجراءات والقواعد الواجب اتباعها عند ملاحقة جريمة ما ومحاكمة فاعلها، في حين يحدد قانون العقوبات الجرائم المخلة بأمن المجتمع والعقوبات الموضوعة لها".
إن قانون (أصول المحاكمات الجزائية) هو ما يدور حوله هذا الكتاب وبالتحديد (القانون رقم 328 الصادر في 18 أيلول 1948 وتعديلاته، والذي كان معمولاً به حتى تاريخه (...)". والمقصود بهذا، التعديلات التي طرأت على قانون أصول المحاكمات الجزائية اللبناني الذي انتظر طويلاً لدى وزارة العدل والذي بدء العمل به ابتداء من 8 تشرين الثاني 2001.
وبمعزل عن صوابية بعض التعديلات والمشاكل التي قد تطرح من الناحية التطبيقية، حاولت مؤلفة الكتاب في هذه الدراسة "المقارنة ما بين القديم والجديد مع التركيز بالطبع على الجديد منه لأنه أصبح هو المطبق". وعليه، يضم هذا الكتاب –وفقاً للمؤلفة- المبادئ الأساسية التي ترعى الأصول الجزائية عامة، وما هو مطبق منها في لبنان... كتاب يحوي مواضيع قانونية ونقاط دقيقة لم يسبق لأي مرجع آخر أن أبحثها، فكان لا بد من طرحها للحاجة إليها في المجال العملي. كتاب وضع لطلاب الجامعات بصورة رئيسية فأتت المنهجية مبسطة واللغة سهلة في شرح نقاط بعيدة أحياناً كثيرة عن الوضوح...".
