قانون العقوبات الخاص هو الفرع المتعلق بدراسة الأوصاف الجرمية بوجهها الطاهر، أي أنه يبين ما هو الفعل المادي الذي لا بدَ منه لتكوين جريمة معينة. بمعنى آخر، إذا كان قانون العقوبات العام يتكلم عن تصنيف الجرائم (...) فقانون العقوبات الخاص يتناول بداية طبيعة كل جريمة وأركانها الأساسية، ليصل في النهاية إلى النتيجة المترتبة على كل فعل.
وهذا الكتاب يعرَف القارئ على قانون العقوبات بقسمه الخاص وعلى المبادئ التي ترعى الجرائم والعقوبات فيه، بالإضافة إلى عرضاً واسعاً لآخر التعديلات التشريعية في لبنان والإجتهادات المختلفة، والمتناقضة أحياناً لهذا التعديل.
وفقاً لرأي المؤلفة مع التعليل، وفي هذا السياق تعيد مؤلفة الكتاب، دراسة أكثر من ست عشرة جريمة جزائية من الأكثر شيوعاً وتعقيداً على ضوء التشريعات الجديدة وخاصة التطور الإجتهادي مدخلة عليها كل جديد طرأ في الإجتهاد ومن خلال دراسة معمقة لكل نقطة ما تزال غامضة في هذا الِشأن، يتخلل ذلك كلام عن "قانون العقوبات الفرنسي" الجديد الذي وضع موضع التنفيذ في الأول من آذار 1994 على ضوء التقدم الحاصل تشريعاً واجتهاداً وتطبيقاً، مع الإبقاء على الإجتهادات القديمة نظراً لتقاربها من النصوص القانونية اللبنانية ولضرورة الإسترشاد بها.
إلى ذلك تتضمن هذه الطبعة بعضاً من "مبادئ قانون العقوباب العام الضرورية لفهم الخاص" وبناءً على ما تقدم، هذا الكتاب يمكن اعتماده كمرجع يستقي منه رجل القانون ما يبغيه من معلومات تطبيقية واجتهادات قديمة وحديثة جاءت نتيجة أبحاث سنوات طوال، خاصة بالمقارنة مع الوضع في فرنسا. كما يمكن أن يعتمد على هذا الكتاب طلاب الجامعات بصورة رئيسة في أبحائهم لما يتميز به من منهجية مبسطة ولغة سهلة...
