تعكس الحرب غريزة أو قوة العدوان لدى الكائن البشري وقد تسبب ذلك في اندلاع العشرات من الحروب التي أدت إلى فناء الكثيرين وقد قضت الحرب العالمية الأولى لوحدها على عشرات ملايين إنسان. وغالباً ما يتعرض المدنيون إلى موجات من العنف حيث يكونون أهدافاً مباشرة للعمليات العسكرية أو لما ينجم عنها. رغم كل ذلك فإن هناك قوانين ومبادئ عامة يعمل بها في فترات الحروب تحدد مسؤوليات القوات المحتلة تجاه الشعوب التي تقع تحت سلطتها.
وقد عمد الدكتور علي عواد إلى وضع هذا الكتاب الذي تبرز الحاجة إليه في هذه المرحلة حيث يحدد في سبقه أبواب واقع قانون النزاعات المسلحة ومسؤوليات دولة الاحتلال والشؤون المدنية والاستقلال (الاستخبارات) وإدارة العمليات. فيبحث في الباب الأول واقع قانون النزاعات المسلحة ومسؤوليات القائد (الرئيس) وواجباته. وسيتعرض في الباب الثاني إدارة العمليات ودور القائد أو أركان القائد على اختلاف اختصاصاتهم في تطبيق القانون. ويعرض في الباب الثالث للحديث عن (الاستخبارات) والاستعلام، ويبين الاستعلام المباح أو المسموح به والقواعد المحددة لهذا الاستعلام.
ثم ينتقل في الباب الرابع للحديث عن شؤون العديد ويبين أن قانون النزاعات المسلحة يحظر قتل أو جرح شخص استسلم وترك سلاحه أو لم تعد لديه وسيلة للدفاع ويجب معاملة الأشخاص الذين استسلموا معاملة إنسانية بوصفهم أسرى حرب أو سجناء وفقاً لطبقية النزاع. أما الباب الخامس فيبحث شؤون اللوجستية (التجهيز) وما يتعلق بها. ليستعرض في الباب السادس مضمون قانون النزاعات المسلحة حيال شؤون المدنيين ومسؤوليات دولة الاحتلال. وأخيراُ يبحث في الباب السابع كيف يمكن تعليم وتطبيق قانون الحرب كما يؤكد أن مسؤولية القائد مسؤولية مباشرة ولا يمكن التنصل منها تحت ظل أية ذريعة.
