وقف هذا الكتاب على تحديد الجريمة وبيان أهميتها من خلال آراء معظم النصوص التي عالجت هذه الجريمة في التشريع العراقي وكذلك الإشارة إلى نصوص الواردة في التشريعات الأخرى فجاء هذا الكتاب مقسما على أربعة فصول يسبقها فصل تمهيدي ضم نظرة تاريخية في جريمة الامتناع تطرق فيها إلى جريمة الامتناع في القوانين القديمة أولا وفي الشريعة الإسلامية ثانيا وفي التشريع العراقي الحديث ثالثا وبعد هذا التمهيد بدأ الفصل الأول في تحديد السلوك الإجرامي فتناول في المبحث الأول معنى السلوك الإنساني ومن المبحث الثاني المفاهيم الفقهية في تحديد السلوك الإجرامي أما الفصل الثاني فتحدث فيه عناصر جريمة الامتناع وعبر مباحث ثلاثة خصص الأول منها العنصر المادي والثاني عنصر الإلزام ووقف الأخير على العنصر النفسي أما الفصل الثالث فتناول فيه المساهمة الجنائية السلبية والمسؤولية الجنائية عن فعل الغير ومن خلال مبحثين تكلم الأول عن المساهمة الجنائية السلبية وتطرق الثاني إلى المسؤولية الجنائية عن فعل الغير وفي الفصل الأخير تناول صور جريمة الامتناع أما الثاني فكان في التطبيقات.
