إن أهم الضروريات في الدنيا هي حياة الإنسان وكرامته لذا أنزل الله سبحانه وتعالى القوانين التي تحمي حياة الإنسان وتنظم له شؤونه والمحافظة على أعضائه ويؤرخه فكان القصاص على الأنفس والأعضاء للحياة وقد سار بعد الناس من قال لا بأس بها لمحاكات الشريعة التي أنزل الله عزّ وجلّ متأثر بالكتب السماوية، ولكن تأثيرهم كان لسوء الحظ بما اعتدى عليه من هذه التعاليم وبما وضعه الأحبار في تعاليمهم، فجاءت هذه الأنظمة التيسير به بصورها الحالية يعتبرها النقص الإنساني أو العجز في كثير من الأحيان، الذي يرضى منه لا يرضى الآخرة ربما في زمان ومكان واحد وزمانين ومكانين متباعدين فجعلوا ما يسمى بإعلان حقوق الإنسان ليحافظوا ويحموا حياة الإنسان إلا أن هذه القوانين جاءت متأخر بأكثر من ألف عام عمّا هو مسطر في تعاليم الإسلام مما يحفظ هذه الأنس ويحمي أعضائها وماله علاقة بها من مال وعقار ونسل وعقل وعقيد وفكر.
يبعث هذا الكتاب بمدخل عن نشأة كل من القانون والشريعة وعن ميزات الشريعة الإسلامية عن القانون مصدراً وثباتاً وصلاحية للناس، ثم يبين في الفصل الثاني الجرائم وأنواعها مع بيان مكانة الإنسان وإحترامه في الشريعة، ثم يبين في الفصل الثالث جريمة القتل العمد مع تحليل أركانها وآراء الفقهاء في ذلك، ثم جاء الفصل الخامس لمناقشة طرق الإثبات في الجرائم مقارناً بين الشريعة والقانون من شهادة وإقرار ويبين القرائن من مستندات خطية وغيرها.
والفصل السادس يبحث في القسامة لإثبات القتل من فاعل مجهول، ثم الفصل السابع لبيان العقوبة تعريفاً وشروطاً وأنواعاً، ثم الفصل الثامن لبيان عقوبة القتل العمد والخطأ وشبه العمد مقارناً بالقانون، والفصل التاسع للبحث في مستحق إستيفاء القصاص، وشروط الإستيفاء ومكان وزمان الإستيفاء مع الكيفية.
أما الفصل العاشر لبيان سقوط عقوبة القصاص ومن يملك هذا الحق، والفصل الحادي عشر الذي يبحث في الجناية على الجنين (الإجهاض) مع بيان التدابير الشرعية لمنع ذلك وتوضيح الأضرار الناتجة عن وسائل الإجهاض ثم بحث القصاص على ما دون النفس عمداً سواء اشترك مجموعة في قطع أو جرح الواحد أو جرح الجماعة، كالقصاص في الضربة واللطمة وأخذ أو إتلاف المال.
والفصل الثاني عشر لتعريف الدية والأحوال التي يجب بها الدية مع بيان متى تغلّط الدية ومتى تخفف وكيف وبيان الحكمة من تحميل ذوي الجاني لقسم من الدية.
