إن طبيعة الحياة العسكرية وما يصاحبها من تطور وتقدم تكنولوجي دائم، قد ضاعفت فرص الخطر التي قد يتعرض لها نظام القوات المسلحة العسكرية وأمنها ووظيفتها.
وبما أن موضوع البحث يتعلق بالجريمة العسكرية التي تمس نظام القوات المسلحة، فيمكن القول أن الجريمة العسكرية أخطر في بعض حالاتها من الجريمة العادية، وذلك بسبب المصلحة التي يتم التعدي عليها وهي المصلحة العسكرية، والتي قد تؤدي إلى المساس بنظام الدولة، وخاصة في مرحلة النفير أو الحرب.
وتكتسب الجريمة الصفة العسكرية بتوافر شرطين: الأول: أن يكون فاعلها ذا صفة عسكرية، ولا تقتصر الصفة العسكرية على رجال القوات المسلحة فقط، إنما يتمتع بهذه الصفة أشخاص حددتهم المادة الثانية من قانون العقوبات العسكري الليبي، الثاني: أن يكون الفعل المرتكب مخالفًا للواجبات العسكرية أو النظام العسكري عمومًا.
ونظرًا لخصوصية هذه الدراسة استخدمنا المنهج التحليلي، والذي يعتمد كذلك على الدراسة المقارنة، وتقتضي دراسة الأحكام العامة للجريمة العسكرية في التشريع الليبي، أن نقسم موضوع البحث إلى، مبحث تمهيدي، وفصل أول، وفصل ثاني، على النحو التالي: المبحث التمهيدي: ماهية الجريمة العسكرية، الفصل الأول: الأركان العامة للجريمة العسكرية والصور المختلفة لها، الفصل الثاني: إجراءات التحقيق والمحاكمة في الجرائم العسكرية.
