تهدف هذه الدراسة إلى الإحاطة بالجوانب القانونية لجريمة الإتجار بالبشر وتحليلها كمساهمة قانونية وعلمية تساعد المشرع في العراق أو في إقليم كوردستان العراق عند معالجته لهذه الجريمة سواء بصياغة نصوص قانونية تضاف إلى القسم الخاص في قانون العقوبات أو من خلال تشريع قانون خاص لمعالجة جريمة الإتجار بالبشر، إذ تهدف إلى بيان تعريف جريمة الإتجار بالبشر وخصائصها وتمييزها عن غيرها من الجرائم وبيان المصلحة الجديرة بالحماية عند تجريم الإتجار بالبشر وتحديد أركانها وعقوباتها والظروف التي تستوجب تشديدها والأسباب التي تستدعي الإعفاء منها، كذلك تهدف الدراسة إلى بيان الجوانب الإجرائية وسبل التعاون الدولي والإقليمي لمكافحتها، ولعل الإعتماد على نصوص الإتفاقات والتشريعات المقارنة هو السبيل الذي يساعد المشرع المحلي على وضع مشروع لقانون مكافحة جريمة الإتجار بالبشر من أجل معالجة هذه المسائل.
وقد رسمنا لهذه الدراسة خطة علمية مبنية على نظام الفصول ونقسمه على أربعة فصول هي: (الفصل الأول: ماهية الإتجار بالبشر، الفصل الثاني: الأحكام الموضوعية في جريمة الإتجار بالبشر، الفصل الثالث: الأحكام الإجرائية في جريمة الإتجار بالبشر، الفصل الرابع: مكافحة الإتجار بالبشر).
