لعل الرغبة في الإحساس بالأمن والأمان هي الأمل الذي يراود الإنسان منذ وطأت قدماه ظهر البسيطة، فالمخاطر تحيق ببني الإنسان منذ بدء الخليقة، وتزداد تلك المخاطر مع تقدم الحياة المعاصرة من الناحيتين التقنية والاجتماعية. ولد التأمين كوسيلة جماعية ترمي إلى إيجاد نوع من التعاون بين أفراده بهدف مساعدتهم على مواجهة المخاطر التي تعرض لأي منهم، ويتمثل ذلك في قيام المشتركين بدفع أقساط دورية تكون مجموع المال الذي يستقطع منه ما يكفي لتغطية الخطر المؤمن ضده. ويرتكز النظام على أسس فنية معينة وعلاقات قانونية محددة.
ونعيش الأن عصر ازدهار التأمين (الضمان) وتنوع مجالاته حيث نجده متغلغلاً في معظم الأنشطة في الدول المتقدمة. وأصبح التأمين يمثل ركيزة أساسية من ركائز الاقتصادية القومي من خلال ما يوفره من رؤوس أموال ضخمة تغذي السوق المالية وتساهم في تحقيق أغراض الخطة والاستثمارات المتنوعة.
وأمام حيوية التأمين وخطورته كانت الحاجة الماسة للتدخل التشريعي لتنظيم عمليات التأمين وبسط الرقابة عليها نن جهة، وحماية الطرف الضعيف (المؤمن له) من تعسف شركات التأمين بما تفرضه من شروط في العقد من جهة أخرى. بل أن الدولة الحديثة أصبحت تفرض بعض أنواع التأمين جبراً إيماناً منها بنفعه وحرصاً على ضمان حصول بعض الفئات على تعويض في مجالات محددة.
وتنصب الدراسة التي بين يدينا والتي هي الثانية في سلسلة "شرح العقود المسماة في مصر ولبنان" على دراسة عقد التأمين باعتباره من العقود المسماة، وفيها تم تناول الجوانب المختلفة للتأمين وذلك في ثلاثة أبواب، وتحدث الأول عن المبادئ العامة لتأمين مضمونه ومقوماته ، وتناول الثاني عقد التأمين: من ناحية خصائصه، إبرامه، آثاره، انقضائه، أما الباب الثالث والأخير فكرس لموضوع التأمين الإجباري من حوادث: المصاعد، المباني، السيارات.
