Book Description
يقصد بقانون العمل، مجموعة القواعد القانونية التي تنظم علاقات العمل الخاص بالتابع المأجور. ولا تقتصر قواعد قانون العمل على تنظيم عقد العمل بل تشمل كذلك الإعداد المهني للعمال وتوظيفهم وتأمينهم اجتماعياً. ويعد قانون العمل من القوانين حديثة النشأة إذ لم يعط ثماره إلا منذ أواسط القرن التاسع عشر. وقد ازدادت أهميته في الحياة العملية حيث يكتسب كل يوم آفاقاً جديدة على صعيد التشريعات الداخلية أو في نطاق المؤتمرات والمعاهدات والمنظمات الدولية.
أما في مصر فقد بدأت محاولات تنظيم العمل في وقت مبكر وبعد تدفق رؤوس الأموال الأجنبية على مصرن حيث ازدادت إعداد الطبقة العاملة وبدأت محاولات العمال في التكتل للدفاع عن مصالحهم فبدأ التدخل بالقانون رقم 14 سنة 1919. أما في لبنان فقد كان تأخر ظهور الصناعة الكبيرة في لبنان من أهم الأٍسباب التي أخرت اهتمام المشروع اللبناني بتنظيم علاقات العمل. وقد بدأ المشرع اللبناني بفرض حد أدنى للأجور في الصناعة والتجارة بالمرسوم الاشتراعي رقم 125 في 10/2/1941. ثم حل محله مرسوم رقم 204 في 27 آب 1942. وصولاً إلى المرسوم 2658 في 15/9/1992. وفي هذا الكتاب يعقد المؤلف دراسة مقارنة لقانون العمل في مصر ولبنان حيث يعرض لذلك في قسمين: قسم يتناول النظرية العامة لقانون العمل. وقسم يتناول عقد العمل الفردي.
