إن حبس المدين يعتبر طريقاً من طرق التنفيذ الجبري في قوانين الإجراء عامة وتنفيذه السلطة العامة بإشراف من القضاء ورقابته، وهو عبارة عن وسيلة استثنائية تهدف للضغط على شخص المدين بحرمانه من حريته لمدة مؤقتة لحمله على تنفيذ التزاماته. وقد تطور مفهوم حجز الحرية الشخصية كعقوبة عن الجرائم التي يرتكبها الفرد وأصبحت فكرة حجز حرية المدين ليفي بالتزاماته أمراً اختلف المشرعون في شأنه.
والقاضي عبد الرزاق رشيد أبو رمان يضع في هذا الكتاب دراسة مقارنة لموضوع حبس المدين في قانون الإجراء الأردني. وقد جاء الكتاب في أربعة فصول، الفص التمهيدي يعرض فيه لحبس المدين في التشريعات القديمة والشريعة الإسلامية والقانون العثماني، أما الفصل الأول فهو يتناول حبس المدين في القانون الأردني.
ويتناول الفصل الثاني حبس المدين في القانون اللبناني أما الفصل الثالث فهو مكرس للطبيعة الحقوقية لحبس مدين وتنازع القوانين وقد خلص الكاتب في النهاية إلى أن نظام حبس المدين التشريعات المختلفة يمثل علاجاً ناجعاً لمشكلة بطء إجراءات التنفيذ وعدم فاعليتها كما أن حبس المدين لا يتعارض مع مبدأ الحرية الشخصية الذي كفله الدستور لأنها ليست حقاً مطلقاً لا ترد عليه القيود. كما أن هذه الوسيلة (الحبس) قد أثبتت نجاحها وفاعليتها في إيصال الحقوق لأربابها.
