تناول الفقهاء ورجال القانون موضوع الوصية من جميع جوانبها وقد جاءت آراؤهم وافية بالغرض. والبحث الذي يضمه هذا الكتاب حافل بمواضيع عديدة تتناول موضوع الوصية للمسلمين حيث يعتمد المؤلف منهج البحث المقارن ويعقد مقاربات بين مختلف المذاهب والقوانين الوضعية المعتمدة في الدول العربية وهو يركز هنا على الدور الأساسي لأحكام الشريعة الإسلامية في هذه المادة واثر ذلك على التشريعات الوضعية المعاصرة. ولم يغب عن باله أن يعرض للوصية الواجبة وقارن بينها وبين "حق الخلفية". واستكمالاً للبحث أفراد باب خاصاً للوصية في القانون الدولي.
والكتاب برمته ينقسم إلى خمسة أبواب عالج في الباب الأول: وصية المسلم السني ومفهوم الوصية وشكلها وقبولها وردها ونصابها والموصي والموصى له والموصى به. أما في الباب الثاني فهو مخصص لوصية المسلم الشيعي. كما بحث في الباب الثالث الوصية الواجبة شرعاً وقانوناً والوصية الواجبة وحق الخلفية في قانون الإرث لغير المحمديين وبحث وصية الدروز وشكل الوصية واستحقاقها وبطلانها. في الباب الرابع قبل أن يختم دراسة بالباب الخامس الذي يتناول الوصية في القانون الدولي الخاص ونطاق تطبيق القانون الدولي الخاص في الوصية والإرث والنظريات المتعلقة به.
