تستأثر حقوق الإنسان كما كرستها المواثيق الدولية والدساتير الوطنية باهتمام المواطن والدولة على السواء باعتبارها هدفاً أسمى تسعى الشعوب إلى تحقيقه كي ينعم أفرادها بالطمأنينة والسلام فلا يهدر حق ولا تنتقص حرية.

وإذا كانت حقوق الإنسان تحتل مكانتها ضمن دراسة القانون العام والحريات العامة إلا أن جزءاً هاماً مما ورد في المواثيق الدولية والدساتير الوطنية يعتبر بمثابة مبادىء عامة دولية ترعى الإجراءات الجنائية حماية للفرد مما يمكن أن يتعرض له من انتقاص في حريته أن مساس في حقوقه من جرّاء الملاحقة الجزائية وما يرافقها من مخاطر على حريته وكرامته وسلامته.

هذا الجزء من حقوق الإنسان استأثر باهتمام المؤلف فقام بتحليل دقيق ومعمق لحقوق الإنسان في الدعوى الجزائية ابتداءً من حقوق المجنى عليه مروراً بحقوق المجتمع ممثلاً بالنيابة العامة ووصولاً إلى حقوق المدعى عليه أمام القضاء الجزائي.

ولم يفت المؤلف دراسة موقع النيابة العامة الإستراتيجي ضمن نظام العدالة الجنائية كما تناول دقائق التحقيق الذي تجريه الشرطة وقاضي التحقيق والمحكمة فيعرض له وصفاً وتحليلاً مع إظهار موقف القضاء الجزائي.

كذلك درس المؤلف وسائل الرقابة الوطنية والدولية على احترام حقوق الإنسان في الدعوى الجزائية باعتبار هذه الوسائل ضمانة فاعلة في تأمين احترام هذه الحقوق.
