يشكل نظام العدالة الجزائية ركناً أساسياً من أركان نظام الدولة المبني على استقلالية السلطة القضايا كما حددتها المادة 20 من الدستور اللبناني. فهو الضمانة لحماية حقوق المواطن والوطن من كل اعتداء يمكن أن يقع عليهما أو على أحدهما من قبل الخارجين على القانون أو غير الملتزمين به. وبقدر ما يكون النظام الاجتماعي والسياسي متطوراً بقدر ما يكون نظام العدالة الجزائية منظماً تنظيماً دقيقاً بصورة يؤمن من جهة فاعلية الأجهزة القضائية في ملاحقة المجرمين بغية محاكمتهم وإنزال العقاب بهم ومن جهة ثانية تؤمن حماية المواطن من التسلط والتصرف المخالف للقانون.
فحقوق المواطن سواء أكان ضحية عمل إجرامي أم متهماً بهذا العمل يجب أن تكون مصانة وبحمى القانون بحيث تؤدي العدالة الجزائية وظيفتها بكل تجرد وموضوعية ضمن إطار من الشرعية والإنسانية. فالقضاء الجزائي بفروعه كافة عامل مؤثر في حياة المواطن والدولة بالنظر لأبعاده الاجتماعية والإنسانية والاقتصادية.
انطلاقاً من هذا الاعتبار وضع المشرع اللبناني نصوص قانون أصول المحاكمات الجزائية الحديث الصادر بتاريخ السابع من شهر آب سنة 2001 تحت رقم 328 والمنشور في الجريدة الرسمية بتاريخ السابع من شهر آب 2001 ويعمل به بعد ثلاثة أشهر م تاريخ نشره أي بتاريخ الثامن من شهر تشرين الثاني سنة 2001. قد تمّ صدور هذا القانون في ظل نصوص دولية ودستورية وقد تضمن صراحة الإشارة إلى هذه النصوص. حيث ورد في الأسباب الموجبة أن الأهداف المبتغاة من القانون التوفيق بين حقوق المجتمع في الأمن والاستقرار والعيش بطمأنينة وبين حقوق الإنسان التي كرسها الدستور اللبناني والمواثيق الدولية ومنها شرعة حقوق الإنسان والعهد الدولي الخاص بالحقوق المدنية والسياسية التي التزم لبنان بكاملها في مقدمة الدستور.
وسيلاحظ القارئ ومن هذه الدراسة التي ضمّها هذا الكتاب والتي جاءت حول أصول المحاكمات الجزائية بأن المشرع اللبناني لم يكتف بالإشارة في الأسباب الموجبة للقانون إلى حقوق الإنسان المحمية بالمواثيق الدولية وبالدستور اللبناني، بل توافق مع هذه الحقوق في معظم ما ورد من نصوص في القانون موضوع الدراسة.
