تزخر المكتبة العربية بكتب الفقه الجنائى التى تعرض نظرياته العامة ومدى انطباقها على نصوص القانون المصرى. كما أن قضاء النقض قد أثرى تجربتنا فى تطبيق تلك النصوص بفيض من الاحكام ذات المبادئ منذ قام فى مصر نظام النقض الجنائى، وفى سبيل الربط بين النصوص القانونية -التى هى فى غالبيتها مستوحاة من تشريعات أجنبية، وبين خبرتنا القضائية المصرية الثمينة التى حصلناها طوال تلك الفترة غير القصيرة- تقوم الحاجة الى أن تعالج النصوص ذاتها معالجة تتميز بأمرين: أنها تستند الى احاطة شاملة بنظريات القانون الجنائى دون كلف بعرض تلك النظريات عرضا منهجيا دراسيا، وأنها تواجه على أساس ذلك فى التزام ودأب -التجارب القضائية التى تبرزها أحكام النقض، فتبوبها طبقا لتسلسل النصوص وتربطها بيها فى تحليل فقهى مستنير يحدد اتجاهاتها ويبين موضعها من الاصول والنظريات العامة.
ويتحقق بذلك فى آن واحد -عرض سهل التناول لثروة المبادئ القضائية المصرية، وايضاح علمى وعملى لمرمى النص وارتباطاته الفقهية والتطبيقية، ويكون ذلك خير معين على استنباط الاحكام فى شأن ما يجد من وقائع أو مشكلات للممارس وللباحث. فضلا عن تيسير الاطلاع على الحلول القضائية المستقرة.
وفى اطار عناية خاصة بابراز حصيلة الثروة القضائية التى نملكها ثم فى سبيل ذلك مراجعة ما صدر من أحكام النقض وما نشر فى مجموعات المكتب الفنى لمحكمة النقض على مدى ما ينوف عن ثلاثين سنة حتى نهاية 1980 فضلا عما تيسر فيما عداها مما نشر قبل ذلك فى مجموعة القواعد القانونية التى قررتها محكمة النقض، وتيسيرا للكشف عن النصوص التى يرجع اليها فى موضوع بذاته وما يتصل به من مبادئ قضائية، تم اعداد فهرس أبجدى حديث لقانون الاجراءات الجنائية.
