جزء جديد من سلسلة "صادر في التمييز-القرارات الجزائية" يطل علينا ليضاف إلى مكتبة كل حقوق يبحث عن الحق في النص أو في الاجتهاد، ليغني هذه المكتبة ويجعلها أكثر مواكبة للتطور القانوني.
ويتضمن هذا الجزء القرارات الجزائية الصادرة عن محكمة التمييز خلال عام 2001 وأهم هذه القرارات يتلخص بالآتي: بالنسبة للغرفة الثالثة، فقد أخذت بمبدأ استعارة القرار التمييزي أو ما يعرف بـ requete en rabat d'arret والمطبق في الاجتهاد الفرنسي منذ العام 1850، وفي إطار المحاكمة الجنائية قضت بأن لا حق للنيابة العامة بالإدلاء بحصول تفهيم القرار الجنائي بغياب المتهم. وفيما يتعلق بالعقوبات فقد خلصت إلى تفسير الوضع لصالح المتهم عند احتراق أوراق الدعوى وتعذر معرفة مدى العقوبة ومن جهة ثانية بجواز وقف تنفيذ العقوبة الجنائية المخفضة إلى جنحية بصرف النظر عن نوع الجرم المرتكب. وفي إطار الجرائم فقد اعتبرت التزوير الحاصل من قبل المختار في وثيقة الوفاة جنحة لاعتبار المختار من الذين يمارسون وظيفة عامة من نوع خاص.
وبالنسبة للسرقة فقد اعتبرت دخول المكان المسروق بواسطة المفتاح الأصلي غير مشكل لظرف مشدد لهذه العقوبة.
وإن كل ما ذكرناه هنا لا يشكل إلا جزء يسير من وابل المبادئ التي أقرتها محكمة التمييز بمختلف عرفها، والتي تم فهرستها هنا في هذا الكتاب بشكل مبسط.
