وتلخيصاً لأهم القرارات الصادرة خلال سنة 2002 نورد ما يلي: بالنسبة للغرفة الثالثة وفي مجال المحاكمة الجنائية، فقد اعتبرت أن إغفال تبليغ المتهم قائمة شهود الحق العام من أسباب النقض، كما وأنها لم تأخذ بعقوبة الإعدام المخفضة إلى عقوبة أخرى كسبب للنقض الجنائي.
وفي مجال الدفوع الشكلية فقد جعلتها شاملة للدفع بالطابع المدني للنزاع بالرغم من مخالفة أحد مستشاريها لهذه النتيجة.
وفي مجال آخر فقد خلصت إلى عدم اعتبار محكمة التمييز صالحة لإعطاء الوصف القانوني للفعل في معرض تعيينها للمرجع.
وبالانتقال إلى قانون العقوبات، فقد قضت بعدم تحقق أحكام التدخل الجرمي لدى مساعدة المتهم شقيقه القاتل على طمر الجثة أو تشجيعه على ذلك لاعتبار فعله من قبيل التدخل اللاحق للجريمة.
وإن كل ما ذكرناه هنا لا يشكل إلا جزء يسير من وابل المبادئ التي أقرتها محكمة التميز، والتي تم فهرستها هنا في هذا الكتاب بشكي مبسط.
