ما مدى شرعية دراسة المعطيات المنهجية لأصول الفقه في ضوء المدارس اللسانية الحديثة كالسيميائيات والتداوليات والفلسفة التحليلية والظاهريات؟ هل يمكن أن نجد داخل المدارس الأصولية في تراثنا ما يفتح لنا باب البحث، وإعادة الدرس لأدلة الشريعة بمناهج حديثة تكون عُدة منهجية لاستثمار النص وإعادة فهمه واستنطاقه؟
إن استيعاب سائر الأدوات المنهجية المتجددة في الخطاب الأصولي إلى آفاق تشريعية لم تكن حاضرة عند الرعيل الأول من الأصوليين يعدّ ضرورة معرفية ومنهجية؛ ليستطيع النصُّ مواكبة التجدد؛ فالأصولي لم يعط لفهمه قداسة؛ فقد يأتي النص قطعيَّ الثبوت والدلالة، أو ظنيَّ الثبوت والدلالة، أو قطعيَّ الثبوت ظني الدلالة، أو ظنيَّ الثبوت قطعي الدلالة، ولكنه يتيح مساحة للخطأ في تأويله، واحتمالاً ممكناً للرجوع؛ لنجد أن النصّ خاضع للسيرورات بين المصطلحين الأصوليين: "النص" و"الظاهر"؛ حسب القرائن الحافة وظروف تشكل المعنى ومحيطات المعتقد؛ لذا لابد من شرعية التزاوج بين مناهج "الذات" ومناهج "الآخر" المعاصر، والكشف عن جوانب الأصالة والالتقاء، والاستفادة من تلك المناهج المعاصرة دونما إخلالٍ بجوهر التشريع وثوابته، أو مسحٍ لهويته العربية، أو محاولة لتقويله، أو تعسُّفٍ أو إسقاطٍ.
