ليست الوصية شيئاً منفصلاً عن حياة البشر العملية بل هي تدخل في صميم المعاملات المالية التي عرضها الإنسان منذ القدم وريما يعود تاريخها إلى تلك اللحظة البعيدة في القدم التي أحس بها الإنسان بدنو أجله وأيقن أنه راحل عن هذا العالم فانشغل بمستقبل عياله ومصيرهم بعد موته فكانت الوصية. وقد نظمت الأديان والأعراف أحكام الوصية وجعلت لها صيغاً محددة. والمؤلف بخبرته الواسعة في هذا المجال كونه أستاذاً في كلية الحقوق، انبرى لدراسة هذا الموضوع بعمق فأفرد هذا الكتاب لدراسة "الوصية لغير المسلمين" وهو جزء من دراسات أخرى يعرض فيها لموضوع الوصية عند المسلمين.
والوصية تتضمن في الأصل حقوقاً مالية وبصورة استثنائية قد تتضمن حقوقاً غير المالية وكيف تعتبر الوصية صحيحة ونافذة وهذا ما يجيب عنه هذا الكتاب الذي يتألف من ثلاثة أبواب يدور الباب الأول حول أحكام الوصية والمتعاقدان في الوصية وموضوع الوصية وسببها، أما الباب الثاني فهو يدور حول شكل الوصية في قانون 1929 وشكلها في قانون الإرث لغير المحمديين، وبطلان الوصية بسبب مخالفة الشكل. أما الباب الثالث فهو بحث في نصاب الوصية والرجوع عنها وسقوطها وتنفيذها. وقد اعتمد المؤلف في الأبواب الثلاثة خطة البحث المقارن اعتمادا على المراجع المختلفة ما كان عربياً منها أو فرنساً.
