المحاكمة، أو التحقيق النهائي، هي مجموعة من الإجراءات تستهدف تمحيص أدلَة الدعوى جميعها، ما كان منها ضد مصلحة المتهم وما كان في مصلحته، وتهدف بذلك إلى تقصَي كل الحقيقة الواقعيَة والقانونيَة في شانها، ثم الفصل في موضوعها، إما بالإدانة أو البراءة.
وتأتي هذه المرحلة من مراحل الدعوى بعد مرحلة التحقيق وإحالة الدعوى أمام قضاء الحكم، وتتميز هذه المرحلة بطابعها القضائي البحت، فالسلطة المختصة بالمحاكمة هي القضاء الجزائي بتعدد جهاته، وقد خصَ المشرَع هذا القضاء بضمانات ستَى بغية ضمان حسن سير العدالة بكافة أوجهها.
ويتبين من مفهوم مرحلة المحاكمة ان دراستها تتطلب البحث في ثلاثة نقاط، الأولى تتمحور حول السلطة التي تختص بهذه المرحلة وبإصدار الحكم، والثانية حول تطبيق المبادئ العامة التي ترعى إجراءات المحاكمة وتأثير الإخلال بهذه المبادئ على الدعوى العامة والحكم الصادر فيها، والثالثة تتعلق بقواعد الإثبات. هذه النقاط ستبحث كل منها في فصل مستقل على النحو التالي:
الفصل الأول: قواعد الولاية والإختصاص القضائيين.
الفصل الثاني: المبادئ السائدة في المحاكمات الجزائية.
الفصل الثالث: قواعد الإثبات في المحاكمات الجزائية.
