ان القانون كما عرفه ارسطو هو تعبير عن العقل مجردا عن الهوا. فالقواعد القانونية هي قواعد منطقية وموضوعية ومجردة وضعت لحماية الحق من الباطل اي تحقيق كل ما هو عدل ، وتجنب كل ما هو باطل ولكن قواعد قانون العقوبات وقانون أصول المحاكمات الجزائية هي قواعد أكثر أهمية لاتصالها مباشرة بحقوق الفرد ، مما يستلزم بالضرورة ان تكون هذه القواعد هي التي تجسد مبدأ سيادة القانون ومبدأ تحقيق العداله على وجه الذي يتلاءم مع أهميتها وخطورتها, فالمسؤولية الجزائية هي أخطر المسؤوليات لأنها تتصل مباشرة بحقوق الافراد وحرياتهم وبمصائرهم ولهذا شرع الكتاب بدراسة الخطورة الاجرامية ووقف التنفيذ وتعدد الجرائم والظروف المخففه للعقوبة والتدخل في الجريمة والفاعل المعنوي للجريمة وإعادة المحاكمة والمحاكم المختصة بنظر الدعوى الجزائية وإعادة الاعتبار والجرم المشهود واسس المعاملة العقابية وأخيرا تحدث الكتاب الضمانات الجزائية للحق في الأمن الشخصي.
