يتمحور البحث حول الحكم الجزائي الصادر بنتيجة قيام خصومة جزائية. فالعدالة تفترض الإقتصاص من الجناة لمصلحة المجتمع والمتضرر من الجريمة، وهي تفترض أن تكون الوسيلة إلى ذلك مشروعة أي أن تجري إجراءات الدعوى وفقاً للقانون وتطبَق في حق الجاني العقوبة المناسبة. لذلك فالإشكالية المطروحة في هذا البحث تتفرع إلى عدة إشكاليات تتمحور حول صحة الإجراء ومشروعيته، والنتائج التي يمكن أن تترتب على تخلّف مقوماته القانونية، والجزاء الذي يلحق بالإجراء المعيب، وما إذا كان يصيب الإجراء ذاته في الدعوى أم يصيب الحكم باعتباره إجراء من إجراءاتها. هذه الإشكاليات المطروحة تبرز أهمية هذه الدراسة من ناحيتين، الأولى تتعلق بأصول المحاكمة والثانية تتعلق بما يجب أن يشتمل عليه الحكم.
يحاول هذا الكتاب إلقاء الضوء على خطة المشرّع اللبناني في مواجهة موضوع البطلان في مراحله المختلفة منذ قانون أصول المحاكمات الجزائية الصادر سنة 1948 لغاية صدور القانون الجديد سنة 2001 مع إبراز التطورات التشريعية ذات الصلة بهذا الموضوع وإبراز موقف الإجتهاد القضائي اللبناني في كل مرحلة من مراحل التشريع وانعكاس أثر تبديل خطة المشرّع من مرحلة إلى مرحلة على قرارات القضاء بهذا الشأن.
