عرفت المادة 638 أصول محاكمات مدنية جديد، الاستئناف "بأنه طعن يقدم إلى محكمة الدرجة الثانية بقصد إبطال أو تعديل حكم صادر عن محكمة الدرجة الأولى". ويفهم من هذا النص أن الاستئناف يعمل على إعادة الدعوى إلى الحالة التي كانت عليها، وبالتالي فهو ليس خصومة جديدة بل هو امتداد للخصومة الأولى سواء من ناحية الأشخاص أو من ناحية الموضوع.
