هذا الكتاب يتناول جانباً من تطورات الوضع العراقي السياسي والدستوري لأن بينهما رابطاً قوياً، إذ لا يمكن فصل السياسة عن الدستور أو القانون. وهو يلقي الضوء على جانب من مشكلات الدستور العراقي منذ أكثر من ثلاثة عقود كنت شاهداً عليها. ويعود هذا الإهتمام إلى أن الدستور والنظام السياسي في العراق يمثلان قضية أساسية هامة تمس جوهر السلام والإستقرار والديمقراطية واحترام حقوق الإنسان التي لا يمكن أن تقوم دون وجود مؤسسات دستورية قائمة على حكم قوة القانون. ومن خلال سطور هذا الكتاب سوف نستعرض بعض مهازل الحكم في العراق قبل سقوط النظام الفاشي ونشير إلى بعض خبراء النظام في القانون الدستوري والفروع الأخرى من الذين دعموا وساندوا هذا النظام، لأن هذه المهازل التي تعرض لها ملايين العراقيين لها صلة وطيدة ببناء الدولة وطبيعتها ونمط الحكم في النظام رغم وجود دستور وقوانين من الناحية الشكلية.
وقد اخترنا للكتاب هذا العنوان (مشكلات الدستور العراقي) لأن هناك مشكلات جوهرية فعلية تتعلق بجذور الدستور التي تمتد إلى مراحل سبقت نفاذه، ومن ثم ما رافق تطورات كتابته من صراعات قوية بين الكتل السياسية العراقية ... وهي ما تزال قائمة. وهناك أيضاً مشكلات تتعلق بمسألة تعديله، وبما محاولات الإنقلاب عليه، على نحو ما سنبيّنه من خلال عرضنا لبعض جوانب المناقشات التي جرت اثناء كتابة الدستور، إضافة إلى مشكلات حقيقية أخرى تخص الكتابة وفن الصياغة ومن بعدها مشكلة التفسير للنصوص الدستورية وللجهة المختصة بالتفسير.
هذا فضلاً عن قضايا متعددة تخص حقوق الكورد في الدستور وبخاصة ما يتعلق برؤيتنا القانونية من الفدرالية وقضية عقود النفط والغاز ومسألة تقاسم الثروة وتوزيعها بصورة عادلة طبقاً لما تقضي به اسس الفيدرالية، والوضع الدستوري لقوات البيشمركة، وحل قضية كركوك ومعوقات تنفيذ المادة 140 وحدود إقليم كوردستان المرتبطة بموضوع المناطق المتنازع عليها.
وعليه، ستكون خطة الكتاب على النحو التالي:
القسم الأول – تطورات كتابة وصياغة الدستور.
القسم الثاني – تفسير الدستور.
القسم الثالث – حقوق الكورد في الدستور.
القسم الرابع: تعديل الدستور.
