هذا الكتاب مجموعة محاضرات في القانون المدني ألقيت على طلبة الدراسات العليا في القانون الخاص في كلية القانون بجامعة بغداد في الأعوام 1988-1991. وهو أحد فصول كتاب (مشكلات المسؤولية من الأعمال الطبية) حاول فيه المؤلف إجراء الدراسة المقارنة فقها وتشريعاً وقضاءً.
تكمن أهمية هذا الكتاب في أنه يسد جانبا من الفراغ في المكتبة القانونية خاصة وأن بحوث (المسؤولية الطبية) لم تنل الاهتمام الكافي من فقهاء وشرح القانون المدني في الوطن العربي. ومن هنا أجرى الكتاب دراسة مقارنة لموضوع المسؤولية الطبية في الجراحة التجميلية فقهاً وتشريعاً وقضاء لذا كان من الطبيعي والمنطقي أن يعرف الكتاب أولاً بجراحة التجميل ومن أجل إجراء مقارنة بين مختلف المذاهب والآراء فقد تعرض لنظرة الفقه الإسلامي للجراحة التجميلية ذاكراً آراء فقهاء المسلمين وأدلتهم الشرعية ولاستكمال المقارنة بيّن الكتاب رأي الرافضين لهذا الموضوع ثم جاء بالرأي الوسط وعرض لرأي المجوزين لإجراء العمليات الطبية والتجميلية، ثم تحدث بعد ذلك عن طبيعة المسؤولية في الجراحة التجميلية فحدد هذه الطبيعة ونوع الالتزام المدني ولمعرفة القواعد العامة في القانون المدني لهذه المسؤولية فقد طرق الكتاب موضوعات مهمة وهي: التنظيم القانوني للمسؤولية الطبية عن الجراحة التجميلية وتنظم المسؤولية في التشريعات المدنية والمسؤولية الجنائية عن الجراحة التجميلية وحكم هذه الجراحة في التعليمات السلوك المهني.
