نشأت المحكمة الإتحادية العليا في العراق بموجب النص الدستوري والذي جعلها مؤسسة قضائية دستورية مستقلة، ذات إختصاصات قضائية سياسية، فهي الجهة الوحيدة التي يحق لها رقابة دستورية التشريعات الصادرة، وكذلك هي الجهة القضائية الوحيدة المسؤولة عن حفظ التوازن بين السلطات الإتحادية في إطار النظام الدستوري البرلماني.
لذلك، فإن إنشاء المحكمة الإتحادية العليا يعد إنجازاً دستورياً كبيراً يستحق التحليل والبحث والدراسة، وهذا من أهم العوامل التي دفعتنا لإختيار هذا الموضوع مادة لبحثنا، خاصة أننا ولحد الآن لم نجد أي بحث يتناول المحكمة الإتحادية بتحليل ودراسة مفصلة من حيث التشكي والإختصاصات والأصول والإجراءات المتبعة - من قبل هيئتها - للنظر في الدعاوى وإتخاذ الأحكام وطبيعة هذه الأحكام ومدى حجيتها.
لذلك، فإننا تناولنا في بحثنا هذا تشكيل المحكمة وإختصاصاتها من ناحية دستورية وسياسية من جهة، ومن ناحية قضائية من جهة أخرى، محاولين من خلال ذلك تسليط الضوء على الوظيفة السياسية للمحكمة الإتحادية المتمثلة بحفظ التوازن والتنظيم بين سلطات الدولة، إضافة إلى التركيز على الصفة القضائية للمحكمة من خلال توضيح الأصول والإجراءات القضائية الواجب إتباعها (دستورياً وقانونياً) في عملية التقاضي أمام المحكمة وإصدار الأحكام من قبلها.
وقد تناولنا هذا كله بأسلوب الدراسة المقارنة، إذ اعتمدنا المقارنة مع الأنظمة الدستورية في الولايات المتحدة الأمريكية وألمانيا ولبنان ومصر والكويت، وذلك بحسب ما يسمح به المقام.
