إن حماية المدنيين هي إحدى الأهداف الرئيسة للقانون الدولي الإنساني، فبموجب القواعد التي حددها لتحكم سير العمليات العدائية، يتمتع السكان المدنيون والأفراد بحماية عامة من آثار العمليات العدائية.
ومع ذلك قد يبدو اليوم مستغرباً، أن الحماية الشاملة الممنوحة للمدنيين لم تكن دائماً موضوع تركيز رئيس في القانون الدولي الإنساني، ذلك أن أصوله، فيما يتعلق على الأقل بقواعد المعاهدات، تعود إلى زمن كان فيه السكان المدنيون محميين إلى حدٍ كبير من التأثيرات المباشرة للعمليات العدائية، ولم يكن يخوض المعارك الفعلية إلاّ المقاتلون.
وتقدم اللجنة الدولية للصليب الأحمر قراءة قانونية لمفهوم المشاركة المباشرة في العمليات العدائية تهدف إلى تعزيز تنفيذ مبدأ التمييز، ويجب، من أجل ضمان الإحترام التام لحظر توجيه هجمات ضد المدنيين، أن يصار إلى التمييز بين القوات المسلحة التابعة لأطراف النزاع سواء أكان هذا النزاع دولياً أم غير دولي والسكان المدنيين.
يسعى هذا البحث إلى تسهيل مثل هذا التمييز من خلال توفير توجيهات لتفسير القانون الدولي الإنساني فيما يتعلق بمفهوم المشاركة المباشرة في العمليات العدائية، ويبحث لهذا الغرض في الرد على أسئلة ثلاثة: الأولى: من الذي يعتبر مدنياً لغرض مبدأ التمييز؟، الثانية: ما هو التصرف الذي يرقى إلى المشاركة المباشرة في العمليات العدائية، ويبحث لهذا الغرض في الرد على أسئلة ثلاثة: الأولى: من الذي يعتبر مدنياً لغرض مبدأ التمييز؟، الثانية: ما هو التصرف الذي يرقى إلى المشاركة المباشرة في العمليات العدائية؟، الثالثة: ما هي الشروط التي تحدد فقدان الحماية من الهجمات المباشرة؟.
أما الأجوبة المقدمة في هذا المبحث والتفسيرات المطروحة من خبراء القانون الدولي الإنساني فتتصدى لأحد أصعب المواضيع في القانون الدولي الإنساني والذي لم يجد بعد حلاً له.
