طه جابر العلواني (1935 - 4 مارس 2016)، هو مفكر وفقيه إسلامي عراقي. كان رئيس المجلس الفقهي بأمريكا، ورئيس جامعة العلوم الإسلامية والاجتماعية (SISS) بهرندن، فرجنيا، الولايات المتحدة الأمريكية. حصل على الدكتوراة في أصول الفقه من كلية الشريعة والقانون بجامعة الأزهر في القاهرة، مصر، عام 1973. كان أستاذاً في أصول الفقه بجامعة الإمام محمد بن سعود الإسلامية بالرياض، المملكة العربية السعودية منذ عام 1975 حتى 1985. في عام 1981 شارك في تأسيس المعهد العالمي للفكر الإسلامي في الولايات المتحدة، كما كان عضو المجلس التأسيسي لرابطة العالم الإسلامي في مكة المكرمة، وعضو مجمع الفقه الإسلامي الدولي في جدة. هاجر إلى الولايات المتحدة في عام 1983. وكان رئيس جامعة قرطبة الإسلامية في الولايات المتحدة.

سيلتقي القارئ في هذا الكتاب بمجموعة أبحاث كتبها المؤلف وهو الدكتور "طه العلواني" في عدة مناسبات، تتوحّد في محاولة التوغل في التراث الفقهي واكتشاف الآليات المعيقة لمواكبة الفقه لمتطلبات الحياة، واقتراح آليات لتنمية فقه تتجسد فيه الأولويات، ويتغلب على غربة الفقه عن العصر، الناجمة عن غربة المسلمين عن مواطنهم، أو غربتهم عن ثقافتهم.
كما يسعى المؤلف في الفصل الأخير لتأصيل مرتكزات علمية للمقاصد تتجاوز المرتكزات التي أصّلها الشاطبي، وبنى عليها ورسّخها مَنْ اقتفى أثره. وهي محاولة لفتح باب الاجتهاد وفي المقاصد، والامتداد بها في فضاء فسيح نلتقي فيه بمقاصد العقيدة بجوار مقاصد الشريعة، ونتعرف على مبادئ ومنطلقات للمقاصد من الكتاب الكريم والسنة النبوية الشريفة لا تتجمد في أفق رؤية الشاطبي ومقلديه. ويجئ نشر هذا الكتاب في سلسلة كتاب مجلة قضايا إسلامية معاصرة بهدف إحياء وتنمية البحث في أهداف الشريعة ومقاصدها العامة لدى طلاب الدراسات الشرعية.
