الإجراءات الجنائية لا غنى عنها في كل جريمة، فهي همزة الوصل بين ارتكاب الجريمة وتوقيع العقوبة على مرتكبها استيفاء لحق الدولة في توقيع الجزاء عليه( )، لذلك تُعَدُّ من أهم القوانين التي تسنها الدولة( )، إذ يتعين فيها على المشرع إقامة التوازن بين مصلحتين متنازعتين بحيث لا تطغى أحدهما على الأخرى:هما حق المجتمع في الوجود، وحق الفرد فقي حريته، فالهدف الأساسي الذي يسعى المشرع إلى تحقيقه من خلال قواعد الإجراءات الجنائية هو العمل على تحقيق هذا التوازن بين مصلحة الجماعة في العقاب، ومصلحة الفرد في الدفاع عن نفسه( ). فالإجراءات الجزائية تتميز بخطورة خاصة لا تقل –بأي حال- عن قواعد التجريم والعقاب المقررة في قانون العقوبات...لأنها تمس الحريات والاستقرار في الحياة الاجتماعية.كما أن قواعد التجريم والعقاب تصبح بعيدة عن الهدف الذي شُرِّعَت من أجله ووسيلة للتحكم والاستبداد بيد السلطة المـُطَبِّقَة للقانون إذا لم تكن هناك قواعد خاصة بالتحقيق الجنائي والمحاكمة والطعن بالأحكام وتنفيذها، تضمن التدبر العميق والتفكير الجاد بمصلحتي المشتكي والمتهم على السواء.وبذلك تكون قواعد قانون أصول المحاكمات الجزائية مباديء واقعية ومنطقية تحفظ للقاضي الملتزم والمحقق المجد رغبتهما المشروعة في تتبع الجريمة، كما تحفظ لأطراف الدعوى حَقهم المشروع في أَلا ينالهم من إجراءات الدعوى غُبن أو محاباة لطرف على آخر. من هنا تبرز الأهمية المتميزة لقواعد القانون الإجرائي ( قانون أصول المحاكمات الجزائية) والتي سنتناولها بالشرح الكامل والمعزز بالمباديء القضائية الحديثة لمحكمة التمييز الاتحادية. آملين أن يكون هذا الشرح وافياً واضحاً ومفيداً للقاضي والمحامي ورجال القانون عموماً، ولرجال الشرطة ممن يتولون التحقيق في الجرائم وتتبعها.كما حرصنا أن يكون هذا الشرح مُبَسَّطاً لا يستغني عنه رجل القانون وكل من تكون له الرغبة في المطالعة والثقافة القانونية، أو تكون له مصلحة في التعرف على أحكام القانون في مسألة معينة تَخُصه.
