يمكن تعريف قانون الإجراءات الجنائية بأنه مجموعة القواعد القانونية التى تتضمن إجراءات البحث عن الجرائم وضبطها, ووسائل إثباتها, وتحدد السلطات المختصة بملاحقة المجرم ومحاكمته وتبين إجرءات المحاكمة وتنفيذ الأحكام الجنائية.
يقوم قانون الإجراءات الجنائية بتحقيق دورين أساسيين هامين: فهو من ناحية, يحقق مصلحة المجتمع فى التمتع بالأمن والطمأنينة بالضرب على أيدى المجرمين, فالعقوبة التى يقررها قانون العقوبات جزاء لجريمة معينة تظل حبيسة النص الجامد أياً كانت جسامتها إلى أن يتدخل قانون الإجراءات الجنائية ليخرجها إلى حيز التنفيذ عن طريق ضبط المجرم وملاحقته ومحاكمته ثم إصدار حكم بإدانته, يمكن بمقتضاه توقيع العقاب عليه, ولذلك يمثل قانون الإجراءات الجنائية بالنسبة لقانون العقوبات حلقة الإتصال أو همزة الوصل بين جزأيه الأساسيين: الجريمة, والجزاء, ويعتبر الأداة الوحيدة لتطبيق قانون العقوبات.
ونقسم دراسة قانون الإجراءات الجنائية إلى الأقسام الأتية: قسم تمهيدى نحدد فيه المبادئ الأساسية فى قانون الإجراءات الجنائية. الفصل الأول ويشمل دراسة الدعاوى الناشئة عن إرتكاب الجريمة. الفصل الثانى ونبحث فيه الإستدلال و التحقيق الإبتدائى. الفصل الثالث: يتناول دراسة التنظيم القضائى والمحاكمة. القسم الرابع: ويشمل طرق الطعن فى الأحكام الجنائية.
