عبّر الفقه بمصطلح القانون الجنائي، عن قانون العقوبات وقانون أصول المحاكمات الجزائية، وعلى الرغم من الإرتباط القائم بين القانونين، فإن كلاً منهما يختلف عن الآخر بسبب طبيعة القواعد التي يشتمل عليها، فعلى حين أن الأصل في قانون العقوبات أنه يضم القواعد الموضوعية التي تحدد ما يعد من الأفعال جرائم والجزاء المقرر لها، فإن قانون أصول المحاكمات الجزائية ينطوي على قواعد الإجراءات التي يلزم اتباعها في تطبيق قانون العقوبات.
يشرح هذا الكتاب قانون "أصول المحاكمات الجزائية" في العراق وفقاً للتشريعات الحديثة، ويناقش عدداً من الحالات الجرمية وكيفية تعاطي القانون معها مقارنة بقوانين بلدان أخرى عربية وأوربية، وتم ذلك في ثلاثة أقسام. يتحدث القسم الأول عن الدعاوى الناشئة عن الجريمة ومنها الدعوى الجزائية والدعوى المدنية، في ما جاء القسم الثاني في الإستدلال والتحقيق الإبتدائي ويدرس نظام الضبط القضائي وإجراءات التحقيق الإبتدائي مثل الأدلة وسماع الشهود وغيرها، ويأتي القسم الثالث في المحاكمة وطرق الطعن بالأحكام ويتمحور حول (مرحلة المحاكمة) في "المحكمة الجنائية العراقية العليا" ورد القضاة أي منع القضاة من نظر الدعوى، وتقييد المحكمة بحدود الدعوى، وحضور المتهم وباقي ومتفرقات ذات صلة.
