إنَّ النظام البرلماني لا يتميّز عن غيره من الأنظمة النيابية بوجود برلمان فيه، أو بأنّه النظام الذي يكون فيه للبرلمان أولوية وأفضلية على السلطة التنفيذية، بل هو نظام وسط بين النظام الرئاسي الذي يحصر السلطة بيد رئيس السلطة التنفيذية المنتخب من قبل الشعب في ظلّ فصل جامد أو شبه جامد بين السلطات، وبين نظام حكومة الجمعية الذي فيه تتركّز السلطتان التشريعية والتنفيذية بيد الهيئة النيابية المنتخبة من قبل الشعب، فالنظام البرلماني - إذن - هو نظام وسط بين هذين النظامين من حيث أنّه يستند إلى التوازن والمساواة والتعاون بين السلطتين التشريعية والتنفيذية في ظلّ فصل مرن بين السلطات.
فقد اعتمد الكاتب هذه الدراسة موضوع أُطروحته على المنهج التحليلي والمنهج المقارن، إذ اتبع المنهج التحليلي، لتحليل النصوص الدستورية والقانونية والقرارات القضائية وآراء الفقهاء، وغربلتها والإستفادة من نتائجها، للوصول إلى حلول وبدائل منطقية لتقييم وتقويم النظام البرلماني العراقي كلما تطلب الأمر ذلك، ومع المنهج التحليلي اتَّبعنا المنهج المقارن، وذلك لأنَّ معرفة نقاط التشابه والإختلاف بين النظام البرلماني العراقي وغيره من الأنظمة البرلمانية، تحتاج إلى إجراء مقارنة بين العراق وتلك الدول على مستوى الدساتير والقوانين والأنظمة، وكل ذلك من أجل الوصول إلى نقاط الضعف ومكامن القوة وتقديم إستنتاجات ومقترحات منطقية وعملية لخدمة موضوع الأطروحة.
