براءة الإختراع هي شهادة تعطى من قبل الدولة وتمنح صاحبها حقاً حصرياً باستثمار الاختراع الذي يكون موضوعاً لهذه البراءة.
يسلط هذا الكتاب الضوء على القوانين التي تدخل في طلب براءة الاختراع والتعديلات التي طالتها بعد ثورة المعلومات والتكنولوجيا، والتي وضعت بمتناول الجمهور في أي مكان أو زمان سواء بوصف خطي أو شفهي أن تراعي أحكام المواد 89 إلى 94 ضمناً من القرار 2385/ 24 المعدل والمتعلق بالاختراعات التي حازت على شهادة ضمان في المعارض والأسواق التجارية الرسمية بمفهوم المادة 11 من اتفاقية اتحاد باريس للعام 1883 المعدلة. وعليه، يبحث الكتاب في القانون 240/ 2000 الذي ينظم براءة الاختراع وكل ما يمت بصلة إلى الملكية الصناعية، بقصد فهم كنهه ومحتواه، خاصة وأن المفاهيم تجاوزت حدود الدولة لتؤلف وحدة لا تتجزأ مما يفرض وبالتالي تحديث القوانين والأنظمة لتواكب المستجد في هذا المضمار.
وللإحاطة بموضوع الكتاب أكثر وزع المؤلف دراسته على جزئين: الجزء الأول ويعالج خلاله أربعة بنود: الاستحصال على براءة الاختراع، براءة الاختراع ومحيطها الإقليمي والدولي، الشروط الموضوعية، مفاعيلها، حماية الاختراع وجرم التقليد داخلياً ودولياً.
