أصدرت محكمة الجنايات في بيروت قراراً تحت الرقم 139/2000 يتعلق بقرصنة برنامج حاسب آلي، سنداً للقانون رقم 75/99، فاتحة أو مفتتحة بذلك أولى الدعاوى القضائية في هذا المجال. تشكل القرصنة على حقوق المؤلف أحد أهم المشاكل التي تواجه العالم الحديث، فتعالت الأصوات منددة ومطالبة بالحماية، وتوجهت الأنظار بنوع خاص إلى دول العالم الثالث كقوة استهلاك، المتهم بتزييف هذه الحقوق، واستثمار المصنفات بدون وجه حق، وجني الأرباح الطائلة.
إلقاء نظرة سريعة على القيمة التقديرية لعمليات القرصنة في العالم لسنة 1997، تظهر الخطورة الكامنة من وراء هذه العمليات التي تعادل 5.3 مليون دولار أميركي تقريباً، وتمثل ما يقارب بيع 1.6 مليون كاسيت و370 مليون CD، أي مقابل كل ثلاث بيعات، واحدة منها مزيفة، وتستمر عمليات القرصنة بازدهار، خاصة في إطار العولمة وفتح الحواجز الجمركية، مما يستلزم إعادة النظر في القوانين الاقتصادية لحماية أصحاب الحقوق ومصالحهم.
لم تتطرق القوانين في العالم لحماية برامج الكومبيوتر إلا مؤخراً، وقد سار لبنان في هذا الاتجاه فأصدر القانون رقم 75/1999 الخاص بالملكية الأدبية والفنية والحقوق المجاورة، وتضمن حماية برامج الكومبيوتر بشكل صريح، مما يتوجب إلقاء نظرة حول هذا الموضوع. لكن إذا كان المشترع شرع حماية حق المؤلف لهذه البرامج، فهل يمكن تطبيق القوانين العامة لحماية هذه البرامج؟ وهل يمكن تطبيقها لتلافي كل الجرائم التي قد تقع على هذه البرامة؟ وفي حال النفي كيف يمكن معالجة هذا الموضوع؟
هذا ما سيتم التطرق إليه في هذا الكتاب والذي يضم دراسة أعدها الدكتور "نعيم مغبغب" حول موضوع "حماية برامج الكومبيوتر الأساليب والثغرات دراسة في القانون المقارن"، تحدث فيها أولاً عن حماية برامج الكومبيوتر على ضوء قانون 75/1999 الخاص بحق المؤلف، وهو النص الشرعي الوحيد المطبق على الكومبيوتر في لبنان. ثانياً: إمكانية تطبيق التشريعات التقليدية على جرائم الكومبيوتر مثل السرقة، إساءة الأمانة، الحصول على الأموال بالتهديد والإتلاف، وإخفاء الأموال الناتجة عن الجريمة...
ثالثاً: محاولة لعرض الأفعال الواجب اعتبارها كجرائم معلوماتية من قبل المشترع اللبناني، وهذا ما يشكل الثغرات الرئيسية في هذا المجال.
