إن دراسة تاريخ النظم القانونية توضح لنا الحالة الأولى التي نشأت فيها الشرائع القديمة وتكونت فيها المبادىء أو النظم القانونية، والوقوف على التطورات التي مرت بها تلك الشرائع والنظم والعديلات المختلفة التي أصابتها في خلال العصور المتعاقبة حتى وصلت إلى حالتها الحاضرة.
فالنظم القانونية السائدة في الوقت المعاصر لم تنشأ من العدم ولم تنشأ طفرة واحدة إذ لم توجد بين عشية وضحاها بل هي ثمرة تطور طويل ونتاج تاريخ حافل بالأحداث، فهي لصيقة بالإنسان ونظم المجتمع الأخرى؛ ولذا فينبغي التعرّف عليها ودراسة تاريخها.
من هنا نتناول في هذه الدراسة أصول النظم القانونية بوجه عام حيث سندرس مصادر القانون في العالم القديم ووسائل تطور الشرائع ثم ندرس أهم النظم القانونية في العالم القديم وبوجه خاص في مصر الفرعونية، وبلاد ما بين النهرين، وعند الفينيقيين وعند العرب قبل الإسلام. وقد تم دراسة ما سبق من خلال التقسيم التالي:
