تتناول هذه الدراسة البحث في تاريخ مصادر القانون والبحث في تاريخ النظم الاجتماعية والقانونية.
إن علم تاريخ النظم يشمل أساساً النظم القانونية في علاقتها بالمجتمع، أي في علاقتها بالنظم السياسية والاجتماعية والاقتصادية والدينية السائدة في المجتمع، وبيان مدى التفاعل بينها. فلا يمكن، في نطاق تلك الدراسة، سلخ القواعد القانونية وتجرديها ودراستها دراسة منفصلة دون النظر إلى الظواهر الاجتماعية أو السياسية أو الاقتصادية أو الدينية أو الفلسفية التي أثرت فيها أو تأثرت بها. ويهتم تاريخ النظم بدراسة نظم القانون الخاص، ونظم القانون العام، كما يهتم أيضاً بدراسة النظم السياسية والاجتماعية والاقتصادية والدينية. أما نظم القانون الخاص فتتناول أساساً دراسة نظام الأحوال الشخصية والميراث والأموال والعقود والالتزامات. وتهتم نظم القانون العام أساساً ببيان نظام الحكم والإدارة ونظام التقاضي والجرائم والعقوبات.
ويرمي البحث في تاريخ مصادر القانون إلى التعرف إلى مصادر القواعد القانونية في شتى العصور، سواء أكان ذلك يتناول البحث في التشريع أو العرف أو الفقه أو القضاء أو التقاليد الدينية، أو غيرها من المصادر، ومن ثم التعرف إلى أهمية كل مصدر في تكوين القواعد القانونية خلال المراحل التاريخية المتعاقبة.
هذا ولم تتعرض الدراسة للمجتمعات أو القبلية، وإنما سوف تركز على الحضارات التي ازدهرت ونمت حول البحر الأبيض المتوسط، والتي تمثل الوجود الحقيقي للنظم وتعد بحق أساساً للنظم القانونية في العصور اللاحقة، ويرجع السبب في ذلك إلى قلة المراجع عن المجتمعات البدائية وندرتها.
