يطلق تعبير القانون الجنائي على نوعين من القواعد القانونية: الأول تلك القواعد التي تحدد نماذج الأفعال المعتبرة جرائم والعقوبات المقدرة لها. والثاني، تلك التي تبين الإجراءات المتعلقة بملاحقة الجاني والتحقيق معه ومحاكمته وتوقيع العقوبة عليه.
فإن دراسة قواعد اصول المحاكمات الجزائية على أكبر قدر من الأهمية، لأنها من ناحية أولى، دراسة للقيود الواردة على الدولة بوصفها سلطة عقاب، ومن ناحية ثانية، تعريف بالضمانات التي تكفل حريات الأفراد وتحمي حقوقهم من غائلة الإعتداء. على ضوء ما تقدم فان تقسيم دراسة أصول المحاكمات الجزائية كالآتي:
الكتاب الأول: يتناول دراسة تأصيلية وتحليلية للقاعدة القانونية الإجرائية: والدعوى الجنائية والدعوى المدنية التابعة لها.
الكتاب الثاني: يتناول سيرورة الدعوى الجنائية. ويشمل ذلك المراحل الثلاث التي تمر بها هذه الدعوى: مرحلة الإستقصاء (جمع الإستدلالات)، ومرحلة التحقيق، ومرحلة المحاكمة.
