وقد التزمت عند تأليف هذا الكتاب المبادئ الآتية: تأصيل الإجراءات الجنائية وربطها بفكرة معينة حتى تنتظم في عقد واحد وعلى ضوء هذا التأصيل يمكن حل كثير من المشكلات وربط كثير من الموضوعات واستخلاص عديد من النتائج المنطقية، استجلاء دور الخصومة الجنائية في التوفيق بين إقرار حق الدولة في العقاب وضمان الحقوق والحريات، مواجهة الكثير من المشكلات العملية واقتراح الحلول لها، إيضاح كثير من الموضوعات التي لم يسبق التعرض لها بالبحث، تدعيم البحث العلمي بأحكام القضاء وتقييم هذه الأحكام على ضوء الأصول الإجرائية التي انتهينا إليها.
