تعد منظومة الحقوق إحدى أهم المنظومات الفلسفية المعقدة التي طالما حاول الإتجاهات الفقهية المتعددة إيضاح ما يحيطها من اللبس والغموض، فكان الحق، مفهومه وجدواه، بل وجوده والجدوى من دراسته، محكوم بالنفي والإنكار عند البعض، محاطٌ بحالة من الريبة والشك عند البعض الآخر، وهذا ما أدى إلى أن تتعدد النظريات والإتجاهات الفقهية والفلسفية والآيديولوجية التي حاولت جاهدةً بيان مفهومه وتحليل جوهره وتحديد ماهيته ومن ثم تعريفه.
إن تعدد النظرات السابقة حتى عند المعترفين بوجود الحق، لم تتوقف عند جانب تحديد المفهوم والمضمون، بل إن ذلك قد تجاوز لتشمل أصل خلقته، فاختلف الفقهاء المعترفون به، وأصبحوا يتجاذبون في تأصيله على وفق المفاهيم الفكرية والفلسفية المتباينة، فتأثرت الخلقة تبعاً لذلك بالمفهوم الطبيعي للقانون تارةً وبالمفهوم الوضعي له تارةً أخرى، بل تأثرت ذلك بالفكر الفردي من جهة وبالفكر الإشتراكي من جهة أخرى.
فذهب البعض نتيجة ذلك إلى عد القانون السبب المنشئ في أصل وجود الحق، والجماعة المحيط الحصري لولادته، إلا أن البعض الآخر ذهبوا إلى إضفاء الأصل الإلهي على الحق، في حين ذهب إتجاه ثالث إلى أن الحق وجد أو ولد مع ولادة الحلقة الاولى، وهذا مسلمة وحقيقة واقعية واضحة، فوجوده أسبق من وجود الجماعة والقاعدة القانونية، فذهبوا على وفقه ليقرون مبدأ سمو الحق على القانون.
لم يتوقف الخلاف السابق، وكنتيجة منطقية، عند الوجود العام لمفهوم الحق، بل أن ذلك تجاوز ليشمل ما يشتمل عليه الحق بمفهومه الواسع، فأصاب ذلك والإنكار أحياناً، مفاهيم (الحريات العامة والرخص والمكن القانونية المكتسبة).
