مضت سفينة القانون تمخر عباب الزمن من سيادة تامة لمبدأ سلطان الإرادة الذي استغرق- أو كاد- كافة مظاهر النشاط البشري في جانب المعاملات حتى كاد كل منصف أن يعتقد- إزاء الوضع القائم- بأن نظرية الظروف الطارئة وما يشبهها من النظريات الأخرى لن تقوم له قائمة نظراً لشيوع هذا المبدأ وازدياد مريديه يوماً بعد يوم. إلا أن دوام الحال من المحال فبين عشية وضحاها أنتكص مبدأ سلطان الإرادة وتغيرت الأفكار وتبدلت النظم القانونية السائدة لتحل محلها نظماً أخرى فكان ذلك إيذانًا بالإعتراف بتلك النظرية. لذلك ونظراً لأهمية مبدأ سلطان الإرادة كنقطة إلتقى عندها معارضو النظرية وافترق منها مؤيدوها فإننا نلقي بعض الضوء في عجالة وكلمة موجزة عن هذا المبدأ ثم وعلى هدى من ذلك نتناول التطور التاريخي للنظرية عبر العصور المختلفة سواء في القوانين القديمة والحديثة ثم نلقي الضوء على موقف الشريعة الإسلامية من هذه النظرية، ونستكمل بعدها نطاق هذه النظرية في الفصل الثاني من البحث، ثم في الفصل الثالث معالجة أثر الظروف الطارئة، وصولاً إلى الفصل الرابع والأخير: نظرية الظروف الطارئة وبعض النظم القانونية الأخرى، ثم الخاتمة.
