يحتل موضوع البحث أهمية خاصة؛ لأنه يمس حقاً أساسياً وجوهرياً من حقوق الأفراد وهو حريتهم في إبرام التصرفات وفقاً لإرادتهم، وبما يحقق مصالحهم دون خضوعهم لجبر أو إكراه طالما كانت تلك التصرفات مشروعة. يعتبر الإكراه من الأنظمة القانونية، والذي يقوم على أساس حماية رضا المتعاقدين وسلامته من العيوب، لأن الإكراه المعيب للإدارة من شأنه إهدار كرامة الإنسان ويسلب إنسانيته ويخرجه عن الإختيار السليم، ونظراً لأهمية الموضوع وحيويته، في التنظيم القانوني اليمني، والذي تناوله في المواد (175- 178)، وقد استلهم المقنن اليمني احكام الإكراه من الفقه الإسلامي دون أن يقيد نفسه بمذهب واحد أو رأي فقهي معين، وإن كان هذا لم يمنع المقنن اليمني من الإستفادة والأخذ من التجارب القانونية المعاصرة في صياغة النصوص القانونية المنظمة للإكراه، كانت رغبة الباحث في اختياره، أما عن خطة البحث فكانت كالتالي: (الفصل التمهيدي: تناول فيه الباحث تعريف العقد ودور الرضا في انعقاده وصحته، الباب الأول: تم تخصيصه لبيان المفهوم العام للإكراه، وفيه فصلان: "الفصل الأول: ماهية الإكراه، الفصل الثاني: أنواع الإكراه وعناصره"، الباب الثاني: شروط الإكراه وأحكامه وتطبيقاته، وفيه فصلان: "الفصل الأول: شروط الإكراه، الفصل الثاني: أحكام الإكراه").
