يجسد الدكتور علي الدراجي في هذا الكتاب، رؤيته القانونية لنظرية الإنعدام الإجرائي في قانون المرافعات المدنية من خلال ما تم طرحه ومناقشته من آراء فقهية قيلت بهذا الصدد فضلاً عن محاولته تأصيل هذه النظرية وردها إلى أصول النصوص القانونية التي أوردتها التشريعات المقارنة، دون أن تكون تلك النصوص قد أشارت إليها بصورة صريحة إذ إنها لم تنظم حالات الإنعدام الإجرائي، معتمداً على ما تناولته الأحكام القضائية من أسس كانت قد وضعتها للقول بالإنعدام في مجالات العمل الإجرائي المختلفة، ساعياً إلى التمييز بين الإنعدام والبطلان، بإعتبار إن كل منهما يمثل جزاء مستقل، له خصوصيته في مجال العمل الإجرائي.
ومن خلال التأمل في صفحات الكتاب، حج إنه قد تبنى نظرية الإنعدام الإجرائي في قانون المرافعات المدنية، بعيداً في مجالات القانون الأخرى إلا بالقدر الذي يحتاج إليه الترابط الموضوعي، من خلال الإسقاطات التي أستمدها من مواضيع القانون المدني، أو الإداري، أو القوانين الجزائية، مستعيناً بالتطبيقات القضائية، ومتبعاً المنهج التحليلي المقارن ومتنقلاً بين العرض والتحليل والإستقراء والإستنباط، وقد يراه القار موفقاً، فيما ذهب إليه من أفكار وهذا توفيق من الله سبحانه وتعالى، وإن رأى في عمله المتواضع هذا هفوات بسيط فهو عمل أنساني، قد لا يخلو من الأخطاء، ومن ثم لا يُجبر القارئ على تبني ما لم يقتنع به، ولكن قد يجبر على تلقي المعلومات القانونية التي لم يكن بإستطاعته الحصول عليها من مصادر اخرى، فهو جهد كبير، ومحاولة جديرة بالتقدير وموسوعة نظم في صفحاتها نظرية متكاملة يحتاجها ويلتجأ إليها، العاملون في المجال القانوني عامة، والمجال الإجرائي بصورة خاصة، ومنهم المحامون والقضاة.
