يعد مصطلح الحماية المدنية من المصطلحات الشائعة الإستعمال في ميادين القانون عموماً والقانون المدني خصوصاً، غير أن مفهومه وعناصره لم تحدد على الوجه الذي يصلح لكافة استعمالاتها، وهذا ما جعل الفقهاء يستعملونه أحياناً بمعنى المسؤولية وأحياناً بمعنى الضمان... ولكن هل أن الحماية تقتصر عليهما؟
يشرح هذا الكتاب معنى الحماية المدنية ومفرداتها بأنواعها، ويسعى إلى استجماع مفردات ومشتملات الحماية المدنية في نظرية عامة، وذلك لتحديد حدود النظرية، في نظاق القانون المدني، ويهدف إلى تحديد الآثار التي تترتب على الحماية، والتي تتغير بتغير أنواع الحماية، لذلك كله اختار المؤلف الخوض في مفهوم الحماية المدنية وعناصرها وبيان أنواعها مع تحديد مواطنالدقة والخلل في المواضيع التي نظمها المشرع العراقي التشريعات المقارنة.
ينقسم الكتاب إلى أربعة فصول، جاء الفصل الأول في (التعريف بالحماية المدنية): ماهيتها، مرتكزاتها، ونظاقها، أما الفصل الثاني فجاء في (الحماية الإحترازية): التسجيل، والتدابير الإحترازية في القانون المدني، وبحث الفصل الثالث في (الحماية الشكلية) من خلال القواعد (الموضوعية) ومن خلال القرائن (القانونية). ويأتي الفصل الرابع والأخير ليبحث في (الحماية الموضوعية المشروطة) و(الحماية الموضوعية المجردة)، و(الحماية الموضوعية المكتسبة). وأخيراً اقتراحات المؤلف على المشرع العراقي في مواد الحماية المدنية...
