كتاب دعاوى المؤسسة التجارية والتمثيل التجاري والمنافسة غير المشروعة هو حلقة جديدة في سلسلة نماذج دعاوى التي اعتمدها المحامي إلياس أبو عيد وأخرج منها بعض الأجزاء.
في الحقيقة، أنه وإن كان هذا النوع من المؤلفات مستحدثاً، فهو دون أدنى شك، يساعد المحامي على الانطلاق في تدبيج استحضار دعواه أو في تركيز لائحته الجوابية أو مذكرته، لكنه لا يغني عن التنقيب، والاعتماد على الجهد الشخصي للمحامي.
لقد اعتمد هذا النوع من المؤلفات لمجرد "مساعدة" المحامي في عمله المهني، على أن يقتصر الهدف منه على "تكملة" نشاط رجل القانون الشخصي. وبذلك، غدا هذا النوع من الكتب عبارة عن vade mecum للمحامي الممارس، أي عن كتاب يبقى بين يديه ليساعده على تكملة جهده الشخصي الذي لا غنى عنه البتة.
فالمؤلف القانوني، مهما علا شأنه وعظمت قيمته، يبقى بحاجة لنفحة شخصية يغدقها عليه واضع الاستحضار أو اللائحة الجوابية أو المذكرة، يبقى بحاجة لطابع شخصي مستمد من لدن المحامي الممارس الذي يعيش قضيته أكثر من أي شخص ثالث.
هذا ما يبرر القول: ب"بأن نماذج الدعاوى"، ككتاب، هو لمجرد المساعدة وتكملة نشاط رجل القانون. فهو، بعبارة أخرى، فرع لأصل.
