إن موضوع (فقه التمثيل النيابي) من الموضوعات الجديدة والمبتكرة، والذي لم يسبق إليها باحث على المكتبات الإسلامية والعالمية ولم تفرد له رسالة علمية مستقلة، كما أفردت لموضوعات مستحدثة أخرى .. فأحببت أن تكون جميع المباحث المتعلقة بالتمثيل النيابي والتكييف الشرعي لها ضمن هذه الأطروحة .. والتي كانت مجال تساؤل ابتداءً من مشروعية النظام ومروراً بالإنتخابات والدعاية الإنتخابية، وانتهاءً بامتيازات البرلماني من حصانة وغيرها كما ناقشت مساحة تشريع القوانين في عمل البرلماني – ضمن حدود الدستور – فهل له الحق في تشريع أحكام تكليفية أو وضعية عامة أو تشريع لأحكام تخالف الأحكام الشرعية بمعنى أن يكون دور البرلماني كدور الفقيه في عمله ضمن منطقة الفراغ وغيرها أم لا؟ ثم التطرق إلى دور الناخب في تشريع القوانين إذا كانت مخالفة للنص السماوي القطعي؟ فهل يمكن إيجاد المبررات الشرعية لذلك وفق العناوين الثانوية وغيرها؟.
كل هذه الإستفهامات كانت أسباباً لاختيار الموضوع.
