في كتابه هذا يسعى القاضي الدكتور "عفيف شمي الدين" إلى ألقاء الأضواء حول قانون أصول المحاكمات المدنية الصادر في العام 1983 المرسوم الاشتراعي رقم 90 الذي تضمن قانوناً عصرياً لأصول المحاكمات المدنية، والذي طرأت عليه تعديلات تبعاً للحاجة. والآن وبعد أن مضى زمن على صدور القانون وعلى البدء بتطبيقه وبعد أن استقر الإجتهاد على تفسير الكثير من أحكامه، دأب المؤلف إلى وضع كتاب بعنوان "المحاكمات المدنية بين النص والاجتهاد" حيث يعمد من خلال هذه الدراسة إلى تفسير النص والاجتهادات الوفيرة التي صدرت منذ وضعه موضع التنفيذ.
هذا، ويقتصر المؤلف على البحث في القسم المتعلق بالمحاكمات منذ تقديم الدعوى حتى صدور الحكم فيها مع ما يرافق ويعترض ذلك من طوارئ وأصول مختلفة، دون أن يمتد البحث إلى طرق الطعن أو إلى اجراءات التنفيذ... إلى آخر ذلك.
هذا، ويتناول المؤلف ثلاثة محاور رئيسية وهي: المبادئ العامة، الإثبات، والمحاكمة بدراسة مسهبة ومستفيضة هي نتاج خبرته النظرية والعملية يفيد منها رجال القانون من قضاة ومحامين وأساتذة جامعات وكذلك الطلبة... جديرة بالإهتمام.
