إن شريعة الإسلام هي الشريعة الصالحة لكل زمان، ومكان، كما قال تعالى: (ونزلنا عليك الكتاب تبياناً لكل شيء وهدى ورحمة وبشرى للمسلمين) (النحل: 89)، ومن ثم كانت قادرة على الوفاء بحاجات الناس المتجددة، وضبط ما يجري بينهم من عقود ومعاملات، وما من عقد جديد إلا والشريعة الإسلامية قادرة على الحكم عليه، وإستيعابه ضمن بناتها الفقهي، وتبقى مسؤولية ذلك ومهمة إبرازه على عاتق الباحثين في علوم الشريعة، فبذلك يحصل تجديد الدين بحيث يواكب تقدم الحياة ويدلي برأيه في قضاياها ومستجداتها.
وعقد الإمتياز التجاري (Franchise) أحد العقود المعاصرة التي تمس الحاجة للوقوف على ما يتعلق به من أحكام؛ بسبب إحتلال هذا العقد مكانة كبيرة في الإقتصاد المعاصر، وإنتشاره بشكل واسع في مختلف مجالات الحياة.
وهو عبارة عن "قد بمقتضاه تسمح إحدى الشركات لشركة أخرى، بإستعمال اسمها وعلامتها التجاريين، وما لها من شعارات ومعرفة فنية، لمدة معينة مقابل تبلغ تدفعه لها هذه الاخيرة، طبقاً للشروط التعاقدية الموقعة بينهما".
