من أكثر المصطلحات التي سرى إليها في عصرنا الإلتباس والإشتباه، وكثر حولها النزاع والإختلاف: مصطلح "التجديد" فبينما هو مصطلح شرعي اتفق على معناه وضرورته أئمة الإسلام، إذ تحول في زماننا إلى مثار جدال وإختلاف، ومبعث قلق وإضطراب، إذ حاول البعض أن يحمله ما لا يحتمل، وأن يلصق به مفاهيم ورؤى غربية عن الإسلام، بعيدة عن حقيقته وجوهره.
ومن أعظم الميادين التي يثور فيها الجدل، ويحتدم فيها الإختلاف، ميدان تجديد الفقه الإسلامي، حيث توجد ثلاث دعوات مختلفة: دعوة ترى أن تجديد الفقه إنسلاخ من الدين وخروج عن سبيل المؤمنين، ويمثل هذه الدعوة بعض متعصبة المذاهب، وبعض أعوام المتدينين وبعض جهلة الدعاة.
ودعوة أخرى، على عكس الدعوة الأولى، ترى أن تجديد الفقه أمر مشروع، بل مأمور به، لعدة أسباب.
