تأتي أهمية هذا التأليف، من حيث كونه إحياء للتراث الفقهي الإسلامي وقانونه الشرعي، فهو كشف هام، لموضوع نفيس، عنوانه "نظريات من الفقه الإسلامي، نظرية التعسف في استعمال الحق ونظرية الظروف الطارئة دراسة مقارنة في المفهوم، والمعايير، ووجه الصلة بينهما".
والمطّلع - فضلاً عن الباحثين والمشرّعين - في مجال القوانين المدنية، لا يجد على الأقل في جلّها، من ربط بين هاتين النظريتين في مفهومهما ومعاييرهما، حين قيام وحدة مناط الاشتراك بين كل من مفهومهما، وبين كل من معاييرهما؛ وقد أتت دراسة هذا التأليف لتأصيل هذا الموضوع من ناحية، الفقه الإسلامي المقارن، فوضع بذلك المؤلف تأصيلاً لقانون شرعي، ينهل منه المشرّع في القوانين المدنية؛ الرأي الراجح، من الفقه الإسلامي ذو الدليل القوي، ما يعينه على سدّ النقص في التشريع المدني، إن في نصوصه، أو في قواعده، التي سكتت عن أحكام وقائع كثيرة تناولها الفقه الإسلامي، وعلماء الشريعة الأفذاذ الذين ألفوا في كلا النظريتين؛ فضلاً عن أن أهمية هذه الدراسة، تأتي أهميتها كذلك، من حيث كونها معيناً لا ينضب، ينهل منه كل باحث قانوني، أو جامعي، في مرحلة الدراسات الشرعية والقانونية العليا، في مجال المقارنات الفقهية الإسلامية، والقانونية الوضعية، بين هاتين النظريتين.
