في الواقع فإن التأمين نوع من أنواع الضمان الذي هو عقد مشروع في الإسلام ولكن مع إجراء بعض التعديلات لتشمل كل شيء قابل للملكية ولو الإعتبارية منها أو المنافع أو الأمور التي لها طابع السلطة والتصرف حيث لا هي قابلة لملكية أعيانها ولا منافعها كما في الإنسان الذي يؤمن حياته، فإن الإنسان لا يملك نفسه حقيقة ولا يملك منافعه، بل هو مسؤول عن نفسه وعن تصرفاته دون وجه الملكية...
وعلى أيّ حال فإن عقد التأمين عقد عقلاني لا ينافي الثوابت الشرعية وهو جارٍ في كل شيء له اعتبار لدى العقلاني ولا يُعد أكلا للمال بالباطل، وأصبح اليوم عقداً محورياً له إرتباط بمعظم العقود والمعاملات والتفاهمات وبات لصيقاً بها لا يمكن الفصل بينه وبينها بحيث أصبح جلها متوقفة عليها.
